The regulations in 40 CFR Part 82 were established to protect stratospheric ozone from emissions of damaging ozone depleting substances (ODS) such as chlorofluorocarbons (CFCs). The subparts contain a variety of requirements for the manufacture and use of these compounds as well as necessary methods for maintaining process equipment and air conditioning systems that contain them. The EPA continues to find a large number of facilities out of compliance with these regulations and has regularly issued fines as large as $5.25 Million. The most common violations are related to the Leak Repair Provisions which apply to equipment containing a refrigerant charge of greater than 50 pounds.
