Enacted in 1986, california’s proposition 65 was meant to address growing concerns about exposure to chemicals believed toxic. Also known as the Safe Drinking Water and Toxic Enforcement Act, the initiative is better known by its original name. But to most businesses, Proposition 65 spells trouble.

A recent rash of highly publicized threats of Proposition 65 lawsuits brought by California bounty hunters has occupied mainstream press headlines of late. These threats have amused, baffled and angered the business community and, given the targets in the hunters’ crosshairs, the general public – especially those with a weakness for chocolate and french fries.
