Amendment of Annex XVII of REACH Regulation.

In the Official Journal of the European Union L 328 of 7 December 2013, it has been published theCommission Regulation (UE) n. 1272/2013 (Annex 1), of 6 December 2013, amending Annex XVII of theREACH Regulation. 

The Regulation entered into force on 27 December 2013 and will be applicable from 27 December 2015.

What are the modifications introduced?

Although polycyclic aromatic hydrocarbons (PAHs) are already subject to two restrictions (entry 28 and 50 of annex XVII of REACH Regulation), the Commission considered that the articles containing PAHs may present an additional risk to the consumers, so a new restriction has been inserted.

In particular in Column 2 of entry 50, the paragraphs 5 and 6 are added, which prescribe:

  • Articles shall not be placed on the market for supply to the general public, if any of their rubber or plastic components that come into direct as well as prolonged or short-term repetitive contact with the human skin or the oral cavity, under normal or reasonably foreseeable conditions of use, contain more than 1 mg/kg of any of the listed PAHs. Then some of the articles included in the restriction are described;
  • Toys, including activity toys, and childcare articles, shall not be placed on the market, if any of their rubber or plastic components that come into direct as well as prolonged or short-term repetitive contact with the human skin or the oral cavity, under normal or reasonably foreseeable conditions of use, contain more than 0,5 mg/kg of any of the listed PAHs.

Finally two more paragraphs are added, which specify that the restriction shall not apply to articles placed on the market for the first time before 27 December 2015 and that, by 27 December 2017, the Commission shall review the limit values in paragraphs 5 and 6 and shall modify these paragraphs, if necessary.
