Transfer of technology: the considerations in international trade and cross-border investment
This paper attempts to explain and evaluate the challenges that are posed by trade agreements and governing frameworks with regard to the transfer of technology. Transferring technology involves many multifaceted agreements and stipulations. It is an intricate set of compliances that have to be adhered to by all the parties involved. The various aspects that are encompassed in such transactions and their potential consequences on developing countries will be discussed. The potential challenges that are attributable to these types of transactions will also be examined in conjunction with the sections of the Trade-Related Aspects of Intellectual Property Rights (TRIPS), as well as parts of the United Nations Conference on Trade and Development.
