Energy Bill

On 19 November 2009, a new Energy Bill was published and given its first reading in the House of Commons. The Bill seeks to (i) provide assistance for carbon capture and storage demonstration projects; (ii) give the Secretary of State discretion to combat fuel poverty by requiring energy suppliers to benefit certain vulnerable groups; and (iii) amend the functions of the Gas and Electricity Markets Authority and the general duties of the Secretary of State in relation to gas and electricity markets.

UK PRIMARY LEGISLATION

Marine and Coastal Access Act 2009

On 12 November 2009 the Marine and Coastal Access Act 2009 received Royal Assent. The Act establishes (i) a new marine planning system; (ii) a new network of Marine Conservation Zones; (iii) a more streamlined marine consenting and licensing system through the creation of the Marine Management Organisation (MMO); and (iv) a new right of access for people to walk around the English and Welsh coasts. The Act also reforms the fisheries management system.

UK SECONDARY LEGISLATION

The Town and Country Planning (General Permitted Development) (Amendment) (Wales) Order 2009 (SI 2009, No. 2193 (W.185))

On 1 September 2009, The Town and Country Planning (General Permitted Development) (Amendment) (Wales) Order 2009 came into force. The Order amends The Town and Coun-try Planning (General Permitted Development) Order 1995 and extends the permitted development rights for the installation of specified types of microgeneration equipment on residential properties in Wales.

Microgeneration equipment that may now be installed, altered or replaced without planning permission on residential property includes solar photovoltaic or solar thermal equipment, ground or water source heat pumps, flues forming part of bio-mass heating systems and combined heating and power systems.
