U.S. EPA Proposes Substantial Refinery Flare Operating and Monitoring Requirements

U.S. EPA is proposing to amend the operating and monitoring requirements for flares at petroleum refineries. The proposed revisions are complex and are far reaching, and if promulgated, will affect all flares at petroleum refineries. U.S. EPA’s stated rationale for the proposed revisions is that the current requirements for flares included in the 40 CFR Part 63 Subpart A General Provisions at §63.11(b) are not adequate to ensure compliance with the applicable Refinery MACT requirements. The General Provision requirements for flares are cross referenced in both the Refinery MACT 1 and 2 standards. Based on U.S. EPA estimates, the emissions reductions that would result from the proposed revisions would amount to 3,800 tons per year of hazardous air pollutants (HAP), 33,000 tons per year of volatile organic compounds (VOC), and 327,000 metric tons per year of CO2e.
