Mesothelioma News - Baron & Budd
The cornerstone practice for our firm has long been mesothelioma. The mesothelioma lawyers with Baron & Budd are still fighting for the rights of mesothelioma patients and their families today, almost 35 years after we were founded. Since our founding, we have had the honor to represent many notable mesothelioma patients, including Admiral Elmo Zumwalt, Jr., a highly decorated veteran of the Vietnam War, and football legend and actor Merlin Olsen.

Time and time again, we have successfully fought many of the major asbestos companies, earning an unparalleled reputation nationally as a law firm that has a history of success both inside and outside of the courtroom. Our mesothelioma attorneys have, in addition to representing individual clients, worked to help create several asbestos bankruptcy trusts. These are not just accessible to Baron & Budd clients, but to all asbestos patients seeking funds from these certain asbestos bankruptcy trusts.
One of the main reasons Baron & Budd is different from other firms is that we handle mesothelioma lawsuits directly. You may think at first glance that a law firm that presents itself as an authority in mesothelioma lawsuits has attorneys on staff who handle these kinds of cases from start to finish. However, that is a misconception. There are several law firms that merely advertise for mesothelioma cases and then “send” them to another firm for the actual case work. This type of wholesale referral philosophy is not, we firmly believe, in the best interests of the client. As you speak to potential law firms, we strongly recommend that you remain aware of this practice.
Many of the mesothelioma verdicts that we have helped bring about were recognized as some of the largest of their type. For instance, we represented a mesothelioma patient in El Paso, Texas who was awarded a $55 million verdict in 2001. The National Law Journal selected the case on its list of the 100 top verdicts of that year. In addition, in 2011, two of our mesothelioma verdicts were chosen as the top two product liability verdicts in Texas in 2011.
We firmly believe in our firm’s mission: Protecting What’s Right. We’ve been protecting the rights of patients and families harmed by asbestos for more than 35 years.
Up until the 1970s, there was little public awareness about the dangers of asbestos exposure. However, asbestos industry insiders already knew about the dangers decades before, but chose to actively hide the truth. Baron & Budd, along with a handful of other law firms, began to fight for justice for patients who had been diagnosed with diseases related to asbestos exposure. Fast-forward to today and you’ll see a law firm that has a more than 35 years of experience consistently obtaining some of the largest settlements and verdicts of their kind for patients and families dealing with mesothelioma. Throughout our history we have also fought to protect the rights of everyone harmed by exposure to asbestos – not just our clients, but patients represented by other firms and people yet to be diagnosed. We achieved this by fighting for the right to file individual lawsuits for mesothelioma rather than be forced into a class action settlement. In fact, Baron and Budd led the fight for patients’ rights in two landmark U.S Supreme Court victories, Amchem Products v. Windsor and Ortiz v. Fibreboard Corp., which are widely considered to be two of the most significany appellate decisions of the past twenty years for consumers’ rights. Our firm was not specifically compensated for its participation in these cases, but instead took the work because we knew that it was the right thing to do.
Baron and Budd adamantly fought the class action settlement. In fact, the firm was instrumental in pushing for the Fibreboard mandatory class action settlement to be thrown out. This settlement would have severely limited the rights of patients and families affected by asbestos exposure to pursue individual lawsuits based on the specific circumstances of their exposure and the severity of their specific illness.
Achieving this success was not an easy task. In these cases, we fought against powerful asbestos interest groups and, surprisingly, against some other plaintiffs’ law firms who were willing to trade future asbestos victims’ rights for a quick pay day. Because of our work in these cases, an asbestos patients’ right to pursue an individual lawsuit is being honored today.
Mesothelioma patients and their families frequently worry that filing a mesothelioma lawsuit will cost hundreds thousands of dollars and may avoid pursuing a case because of this fear.
Our mesothelioma lawyers handle all mesothelioma lawsuits on a contingency fee basis, meaning that you do not pay anything up front and that we handle all of the costs needed to handle your lawsuit through completion. We only get paid if and when we achieve a positive result for you as part of the contingency fee agreement. This contingency fee is an agreed-upon percentage of the total result of the lawsuit, obtained either through a settlement, verdict or asbestos bankruptcy trust claim. By operating under this system, anyone has the opportunity to pursue justice from the asbestos companies responsible for their mesothelioma, regardless of their financial situation. This system helps to keep the courtroom doors open to anyone in the country seeking justice for wrongdoing.
Working through your case in this way, our mesothelioma lawyers will conduct all legal proceedings and pay all legal costs incurred during the course of your lawsuit. We will pay all required filing fees, litigation costs, expert witness costs and anything else needed until your lawsuit has been completed. If we are successful in obtaining compensation for you, then we will be paid a percentage of the final amount plus all fees and expenses incurred during the process. What does this mean for clients? The use of the contingency fee system has a well-recognized history of giving individuals the ability to level the playing field against large companies who have caused major injustices to consumers, their employees or even the unsuspecting public. These companies have the resources to hire powerful legal teams, and without the use of contingency fees, most patients would find it impossible to pursue legal action. Our mesothelioma lawyers are honored to work under this system to better assist clients. Today contingency fees are an important way to uphold justice for every individual, regardless of social and financial status. We take pride in representing clients on a contingency fee basis.
