Luneburg, Germany -- Nordson Corporation (Nasdaq: NDSN) and UES AG (“UES”) of Krefeld, Germany, have reached an agreement on UES's infringement of Nordson's European patent EP1568418 relating to hot melt adhesive modules, manifolds, and/or applicators having a proprietary mounting interface.
Under the terms of the agreement, the specifics of which are confidential, UES received a Covenant not to Sue (a special type of license) for past sales and agreed to stop manufacturing and selling the licensed products.
Nordson's European patent EP1568418 had previously undergone opposition proceedings initiated by UES before the European patent office. The opposition challenging the validity of the patent was rejected by the European patent office and Nordson’s European patent was maintained, removing all doubts concerning the validity of the patent.
Ulrich Bender, Director Packaging Europe, indicated that Nordson will now be embarking on a licensing program to offer a Covenant not to Sue/License to other companies that have manufactured, marketed and/or sold modules, manifolds, and/or applicators in violation of Nordson's European patent EP1568418. While Nordson is willing to license various mounting interfaces covered by European patent EP1568418, it will not be licensing the EasyOn™ or Bowtie® mounting interface, which can be found on a number of Nordson product lines, including the SolidBlue™ and MiniBlue® II applicators and modules.
The EP1568418 is in force in France, Germany, Italy, Spain, Sweden, Switzerland and United Kingdom.
