Due Diligence / Regulatory Compliance

Preparation of environmental site assessments for due diligence associated with property transactions, and facility environmental compliance audits are an important part of the comprehensive services provided by Farallon. Our staff has extensive experience in the technical aspects of site assessments and operating facility audits, understand the regulatory requirements associated with operating facilities, and have worked extensively with developing mitigation strategies and costs associated with short- and long-term environmental liabilities relative to operating facilities and abandoned sites. Farallon provides the proper documentation required by regulators, financial institutions, and stakeholders; and experienced technical support during property transaction negotiations.

Insurance Claim Evaluation

Farallon has demonstrated expertise and experience in providing technical support to insurance carriers administering claims for contaminated properties and evaluating potential environmental issues while writing policies. Farallon provides technical support during cost recovery actions for completed cleanups regarding whether a remedial action undertaken was necessary and complied with governing state or federal regulations, and costs incurred were reasonable and customary. Farallon also provides technical support for sites where environmental cleanup is ongoing or anticipated in the future. Another offered service is providing third-party oversight on behalf of insurance carriers, evaluating scopes of work and costs either proposed or incurred by others for investigation and cleanup work. For cases where third-party claims have been imposed against an insured, Farallon provides expert litigation support during cost allocations and mediations.

Mediation & Litigation Support

Farallon provides clients and legal counsel with technical support for an array of environmental mediation and litigation matters. Support services include evaluation of cleanup cost necessity and reasonableness, mediation and arbitration assistance, and development of technical strategies for litigation. Farallon also prepares technical briefs, Expert Reports, and Rebuttal Reports, and provides expert opinion, rebuttal opinion, expert witness testimony, and testimony as a witness of fact for mediation and litigation. Farallon additionally provides services for private-party cost recovery for environmental investigation and cleanup and for development of allocation programs for sites involving multiple potentially responsible parties.

Site Characterization

Farallon’s professionals have a broad range of expertise in developing and implementing site characterization programs to evaluate the source and distribution of contamination in soil, groundwater, and surface water in complex geologic environments. A successful site characterization program is a fundamental component for developing technically feasible and cost effective remedial strategies. Farallon prides itself on developing the most appropriate scope of work that addresses the technical, financial, and regulatory considerations of each individual project.

Engineering & Remediation Services

Farallon provides clients with engineering expertise and full-service remediation management for feasibility testing and the design and implementation of cleanups at operating and abandoned sites.  Successful remedial actions resulting in regulatory closure have been completed at large-scale industrial sites such as bulk fuel storage facilities, lumber and pulp mills, chemical and steel manufacturing sites, pesticide distribution facilities, retail fuel stations, and metal plating facilities.  Farallon’s engineering staff include innovative licensed Professional Engineers averaging 30 years of experience in their field of expertise.

Landfill Services

Farallon provides engineering design and permitting support for landfill caps, landfill gas management controls, stormwater management issues, and compliance with the Minimum Functional Standards for Solid Waste Handling as established in Chapter 173-304 of the Washington Administrative Code. Farallon has provided engineering and permit compliance services for two of the largest operating municipal waste landfills in the Pacific Northwest for over a decade and is currently working with other smaller existing and former landfill facilities to manage a wide variety of environmental needs.

Stormwater Management and Spill Prevention Planning

Farallon provides comprehensive stormwater management services to public and private sector clients. Specific project experience includes Stormwater Management Program development and implementation; source control evaluation and mitigation; Stormwater Pollution Prevention Plan and Spill Prevention, Control, and Countermeasure Plan development; stormwater and industrial waste management; and best management practices design, construction, and implementation. Farallon also has field and project management experience monitoring surface water quality compliance and supporting stormwater and wastewater discharge permitting.

UST/AST Investigation and Remediation

In the course of conducting hundreds of site investigations and cleanup actions, Farallon has managed numerous properties currently or formerly containing underground and aboveground storage tanks (USTs and ASTs) and associated distribution piping, loading racks, and dispensers. From investigating the environmental status of a single heating oil tank at a residential property to overseeing the decommissioning of over 150 USTs and ASTs at a military base, Farallon has a long history of successfully resolving environmental issues involving the operation and management of storage tanks at a wide variety of facilities.
