Exhibitors, exhibitsAdmitted as exhibitors aremanufacturers, importers, exporters,representatives, vendors thatprovide services and products thatcomply with the topics of theattended event. Exhibits must besummarized and assigned ingroups of products in the F3 form.Products (copies, counterfeit etc.)that don't comply with regulationsthat protect industrial andintellectual property available inRomania, will not be admitted asexhibits at ROMEXPO. Theexhibitor must obtain the permitprovided by the law for the productsand services presented. Sellingproducts and services is allowedonly according with the Romanianlaws. The exhibitor is responsiblefor respecting the law. Participation in fairs and exhibitionsorganized by ROMEXPO is basedon Special Conditions and Generaland Technical Conditions that willbe acquired by the exhibitors priorto the event they participate.2. Registration and participation2.1 Exhibitors shall complete andsubmit the F1 form and ROMEXPOwill send the invoice and allocationproposal.2.2. Registration fee includes: companyregistration in the official faircatalog, printed invitations for freeaccess, general maintenanceservices, pedestrian passes,appearance in the list of exhibitorspublished on the website,introduction of the dates in ourinformation system for visitors.2.3 If ROMEXPO cannot provide therequired space it will providealternatives. Area allocated bymutual agreement may vary to theone requested, or participation maybe refused by the organizer.2.4 Space location will be made on a"first come, first served" principle.2.5 Confirmation of exhibitor's rentedspace will be the payment of 30% ofthe invoice within the date stipulatedand informing ROMEXPO of thepayment.2.6 If the exhibitor fails to pay 30% fromthe invoice within the datestipulated, the rental spacereservation becomes invalid andthe registration procedure must berepeated again.2.7 Confirmation of the stand project bythe exhibitor will be made within 5days after the written notice sent bythe organizer. Lack of notification inthis regard and within the periodspecified above it is considered tacitacceptance of the exhibitor.2.8 ROMEXPO will not grant access toexhibitors within the allocated areaif they have not fully paid the issuedinvoices.3. Withdrawal from the fairIf after concluding the contract andthe payment the exhibitor cancelsparticipation then:? 30% of the total paid amount will beretained if exhibitor cancels within60-45 days before the fair’sopening;? 50% of the total paid amount will beretained if exhibitor cancels within44-30 days before the fair’sopening;? 70% of the total paid amount will beretained if exhibitor cancels within29-15 days before the fair’sopening;? 100% of the total paid amount willbe retained if exhibitor cancelswithin less than 15 days before thefair’s opening;The contract is canceled and theamount already paid by theexhibitor will be retained under thetitle of, damages for pecuniary andmoral damages according to theabove terms.4. Terms and payment4.1 For rented space with standardstand (F1 - D1 form) according toart.24.2 For rented space with customizedstand: 30% within 10 days from thedate of the project and price offerconfirmation, and the remaining70% within 10 days before thebeginning of the event.If the exhibitor does not pay theremaining 70% of the customizedcontracting stand, he will lose the30% deposit paid and the standconstruction will not be executed.Payment of the invoice stipulated inart. 4.1 and 4.2 will be made bybank transfer before taking over thestand (in advance) in one of thefollowing bank accounts:? Program5.1 Access program for exhibitors:? During the construction / development ofthe stands, 25.10.2013 - 29.10.2013,exhibitor's personnel access will bepermitted daily between 8:00 a.m. and8:00 p.m. Removing the exhibits or standdismantling may start on 03.11.2013between 16:00-20:00 and from the04.11.2013 to 05.11.2013 between 8:00a.m. and 8:00 p.m.? During the exhibition, the access forthe exhibitor's personnel will bepermitted daily between 8:30 a.m.and 6:30 p.m., and between 8:00a.m. to 8:00 p.m. on the 03.11.2013.? The exhibitors have the obligationto strictly respect the exhibitiontimetable and not to leave therented stand unattended until theend of the event.? If a stand is unclaimed until 6:00p.m. on 29.10.2013, the last day forconstruction, it will be allocated toother companies and ROMEXPOwill consider that the exhibitor hascanceled the participation.? Each exhibitor will receive, inaccordance with the area allocated,pedestrian access cards for thewhole period of the event. Theexhibitor will also benefit of free ofcharge pedestrian passes duringthe construction and dismantlingperiod.? On all access cards it will bementioned the name of the exhibitingcompany. Cards are not transferable.ROMEXPO reserves all right toretain any card that is not usedproperly. ? Exhibitor's cars have no accesswithin the Exhibition Center duringthe fair and during construction anddismantling. The cars will be parkedin the parking space provided to allexhibitors. During the constructionand dismantling period onlyvehicles with merchandise for theexhibitors stand will have access tothe pavilion or exhibition area. Theywill be evacuated from the area onthe last day of the arrangement ofthe stands, no later than 8:00 p.m.These vehicles also have dailyaccess to supply the stand duringthe exhibition from 6:00 p.m. to 6:30p.m. to supply the stands. After this,they will have to leave the area.5.2 Access program for visitors:? Between 30.10.2013 and 02.11.2013from 10:00 a.m. to 6:00 p.m.? In the last day, on the 03.11.2013,from 10:00 a.m. to 4:00 p.m.6. Co-exhibitors6.1. Co-exhibitors are those firmsrepresented in a stand with its ownpersonnel and exhibits togetherwith the main exhibitor.6.2 Participation of co-exhibitingcompanies is accepted after fillingthe F4 Form by the Exhibitor. Co-exhibitor enjoys the sameconditions as the main exhibitor. Ifco-exhibitor is not registered, themain exhibitor will pay a surchargeof 150 Euro + VAT/companycompared to the rate in the form F4.6.3 In accordance with regulationsadmission, co-exhibitors may beintroduced in the catalogue withtheir completed companyinformation if the full rates relatedhave been paid and requireddocuments have been received bythe specified deadline (see FormF4). For the participation of a co-exhibitor a registration charge of150 EUR/co-exhibitor + VAT is to bepaid. This charge includes the following:? The introduction of co-exhibitor inthe event catalogue? Introducing in the visitorsinformation system ? A free copy of the official catalog ofthe exhibition? 2 free pedestrian access cards? Invitations to the opening ceremonyand cocktail7. Advertising within the ExhibitionCenter7.1 Exposure and distribution of leafletsand promotional materials is free inthe surface rented by the exhibitor(own stand). This activity can bemade outside the stand only againstpayment, by completing the S12Form. Advertising is limited to thepromotion of exhibitor products, willnot violate the legal provisions andwill not have political or ideologicalcharacter. Comparative advertisingis not allowed. The organizer hasthe right to remove, withoutexhibitor's agreement, markings,advertising and other forms ofadvertising made inside or outsidetheir own stand, if it considers thatthey are not in accordance with theRomanian legislation, theparticipation conditions or if itbothers other exhibitors.7.2 Romexpo reserves the right toprohibit the display or distribution ofadvertising materials that could giverise to the offense of otherexhibitors and will addressmeasures that will seize during theevent, all stocks of advertisingmaterials.7.3 Advertising in optical media, mobile,sound (up to 60 dB) is allowed onlyif exhibitors does not botherneighbors and does not cover thesound of Pavilions (radio ads, etc.).In violations of these provisions,Romexpo reserves the right tointerfere and stop the advertisingtransmission. Exhibitors will have tocomply with the Provisions ofCopyright.8. Security. Liability8.1 Romexpo provides general daily securityoutside the pavilion and its outdoor areawithout being held responsible for thesafety of products on display. Property orpersonal insurance is recommended.This can be done by specializedcompanies at the necessary fees.In case of any theft, the exhibitormust reclaim the incident at Police.Exhibitor is responsible for thesecurity of goods during the dailyschedule, in accordance with art.5.1.8.2 Exhibitors will comply with fireprevention laws, laws that helpprevent work accidents and theones reffering to possible damagescaused on the territory of RomexpoCenter by visitors or exhibitors,according to the Romanian CivilCode. Smoking within indoor areasis strictly prohibited. Smoking ispermitted only in speciallydesignated outdoor areas.9. Intern authority9.1 Romexpo has full authority duringthe exhibitions held in the ExhibitionCenter, from the beginning ofconstruction period until the end ofdismantling period. Romexporeserves the right to issueinstructions. Romexpo reserves theright to make audio/video recordswithin the exhibition area, in order tobe used for promotion purposes.10. Force Majeure10.1 Force majeure, agreed as beingthat event that is unpredictable andunavoidable, released after theconclusion of the contract and thatprevents the party or parties to fulfillthe obligations assumed bycontract, is exempting from liabilitythe party that invokes it, from aclaim under the law conditions. Thecase of force majeure shall becommunicated by the interestedparty within 2 (two) days of itsappearance and will be confirmedby official documents authenticatedby the Chamber of Commerce andIndustry of Romania. Documentaryevidence proving the existence offorce majeure will be presented tothe other party within 5 (five) daysfrom the date they are issued by theChamber of Commerce andIndustry of Romania.10.2 Termination of a force majeureevent, confirmed by the Chamber ofCommerce and Industry ofRomania, will be immediatelycommunicated to the interestedparty.10.3 Parties undertake to make allpossible efforts to limit the temporaleffects of force majeure. A trade faircan be canceled or the date ofopening/ closing can be delayed incase of force majeure. Litigation11.1 Any dispute arising from or inconnection to the contract herein,including the ones related to itsconclusion, execution ortermination, shall be settled by theInternational Court of CommercialArbitration attached to theRomanian Chamber of Commerceand Industry, according to thecurrent Rules of Arbitral Procedureof the International Court ofCommercial Arbitration, publishedin the Official Journal of Romania,Part I.The parties undertake to carry outthe court's decision which is finaland binding.These Special Conditions are to becompleted with the Technical andGeneral Conditions of Fairs andExhibitions Center, according to theDirective 2008/8/EC with ismodifications applied starting with01.07.2011, and the Directive2006/112EC from the 28.11.2006,regarding the common systems ofvalue added tax.
