Saleplas, S.L. se reserva el derecho de modificar tanto sus catálogos como tarifas sin previo aviso, así como las características y especificaciones de sus productos, con el fin de prestar un mejor servicio a nuestros clientes. Segunda. Todos los precios reflejados en nuestras tarifas no incluyen IVA o cualquier otro impuesto, que serán por cuenta del cliente. Los precios son válidos para España. Tercero. Los precios son para material puesto en nuestros almacenes de Madridejos (TOLEDO). Los portes se aplicarán según el importe de pedido realizado (ver mapa en www.saleplas.es). Cuarta. Los pedidos deberán realizarse por escrito, llevando la firma y sello del cliente o por teléfono, los cuales se tramitarán en caso de que el cliente no exprese ninguna disconformidad pasadas 24 horas del envío de la confirmación de pedido, debiendo ajustarse a estas Condiciones Generales de Venta. Saleplas, S.L. no se hará responsable de errores de transcripción en los pedidos telefónicos que sus clientes no confirmen por escrito. Los pedidos podrán suministrarse parcialmente, sin que ello suponga una anulación del mismo. Sale-plas, S.L. no estará obligado a suministrar información o datos técnicos para materiales que no aparezcan en nuestros catálogos o tarifas, considerándolos como pedidos especiales. Quinta. Los plazos de entrega serán a contar en días laborales a partir del día siguiente de la confirmación del pedido, siendo la fecha de entrega la de salida del pedido de nuestras instalaciones. El incumplimiento de los plazos de entrega por causas ajenas o no directamen-te imputables a Saleplas, S.L., no dará lugar a compromiso o responsabilidad ninguna. Sexta. No se admitirán devoluciones, anulaciones o modificaciones de pedidos de material especial y productos comercializados que no estén en stock y se adquieran exclusivamente para nuestros clientes, salvo que Saleplas, S.L. lo autorice expresamente. En caso de que fuera autorizada la devolución, anulación o modificación, Saleplas, S.L. se reserva el derecho de modificar los descuentos, PVP o la forma de pago e incluso de aplicar un % de penalización por los gastos ocasionados. Tampoco se admitirán devoluciones de material estándar transcurrido un año de su recepción por parte de nuestros clientes. Para pro-ceder a una devolución, debe existir confirmación por escrito de Saleplas, S.L. Los productos devueltos, deberán estar en perfecto estado y enviarse embalados y a portes pagados a los almacenes de Saleplas, S.L. situados en la Ctra. Consuegra – Madridejos, km 6,400, en Madridejos (TOLEDO) CP 45710. Séptima. Cualquier reclamación por defecto de fabricación deberá realizarse por escrito y en un plazo máximo de un año desde la entre-ga del material, debiendo el cliente enviar correctamente cumplimentada la correspondiente hoja de incidencia y muestras del material defectuoso en caso de que fuese necesario en los 15 días siguientes a la apertura de la incidencia. Una vez aceptada la reclamación, el cliente tendrá un periodo máximo de 1 mes para poner el material objeto de la reclamación a la disposición de Saleplas, S.L. para su recogida. La responsabilidad de Saleplas, S.L. es la de reemplazar los materiales defectuosos, excluyéndose cualquier otra responsabili-dad de indemnizaciones o daños causados por nuestro producto. Saleplas, S.L. no se hará responsable de los posibles problemas deriva-dos del transporte realizado por agencias privadas de transporte. Octava. La garantía de nuestros materiales es de un año a partir de la fecha de suministro, que será la que conste en el albarán de entre-ga. Una mala instalación/manipulación de nuestros productos anulará cualquier garantía o responsabilidad por parte de Saleplas, S.L. Novena. Los pagos serán siempre al contado o con transferencia antes de la entrega del material, salvo concesión o crédito convenido. No se admitirán retrasos en los pagos bajo ningún concepto, ya que toda falta de pago anula cualquier garantía de los productos suminis-trados, así como paralizará los pedidos pendientes con el cliente si los hubiera, dando el derecho a Saleplas, S.L. tomar las medidas nece-sarias para garantizar el cobro del material suministrado. Décima. Nuestro horario de atención al público tanto de manera telefónica como de manera personal en nuestras oficinas será: por las mañanas de las 9 a las 14 horas, y por las tardes de las 16 a las 19 horas desde el 1 de Febrero al 30 de Septiembre y de las 15 a las 18 horas desde el 1 de Octubre hasta el 31 de Enero. Undécimo. De conformidad con la Ley 15/1999, de Protección de Datos, el cliente entiende y acepta que una vez solicite un presupuesto o realice un pedido, sus datos pasarán a formar parte de un fichero cuyo responsable es la empresa Saleplas, S.L., que los tratará de for-ma confidencial y cuya finalidad es la gestión de las relaciones contractuales, envío de ofertas comerciales y material publicitario. El cliente podrá ejercer sus derechos de acceso, modificación o cancelación requiriéndolo por escrito a Saleplas, S.L. Ctra. Para resolver cualquier litigio o cuestiones sobre la aplicación de estas condiciones, tanto Saleplas, S.L. como el cliente, con-vienen someterse a los Juzgados y Tribunales de Toledo, renunciando a su propio fuero si éste fuese otro. 8 GENERAL SALES CONDITIONS Saleplas, S.L. with VAT No. ES B-45226412, establishes the following sales conditions and understands that the customer accepts them when placing an order: First. Saleplas, S.L. reserves the right to modify both the catalogues and price lists at any time without prior notice, as well as the charac-teristics and specifications of the products to provide a better service to our customers. Second. All the prices shown in our price lists do not include VAT or any other tax or cost, which shall be borne by the customer. The prices are valid for Spain. Third. The prices are for materials stored in our warehouse placed at Madridejos (TOLEDO). The transport charges will be applied accord-ing to the amount of the order (see map on www.saleplas.es). Forth. The orders must be made in writing, including the sign and seal of the customer, or by telephone. If no disagreement is expressed by the customer, the telephone orders will be managed 24 h after sending the order confirmation document in compliance with these General Sales Terms. Saleplas, S.L. will accept no responsibility for any transcription mistake in the orders made by telephone that have no written confirmation by the customer. The orders may be supplied partially, without constituting a cancellation. Saleplas, S.L. will not be obliged to supply information or technical details for the materials that are not listed in our catalogues or price lists, considering them as special orders. Fifth. The delivery times are estimated in working days from the next day of the confirmation of the order. The date of the delivery refers to the date of dispatch of the goods from our premises. The failure to comply with the delivery dates due to causes beyond our control or not directly attributable to Saleplas, S.L., will not give rise to any commitment or responsibility. Sixth. Orders of special products or merchandise that is not in stock and is purchased exclusively at the request of our customers cannot be returned, cancelled or modified, unless expressly authorized by Saleplas, S.L. In the case that the return, cancellation or modification is accepted, Saleplas, S.L. reserves the right to change the discounts, prices or payment method. A penalty percentage may be applied for the expenses caused. Returns of standard products after a year from the reception by the customer will likewise not be accepted. To arrange the return of the merchandise, there must be a written confirmation by Saleplas, S.L. The returned goods must be in good order and sent packed and freight pre-paid to our warehouse located in Ctra. Consuegra – Madridejos, km 6,400, en Madridejos (TOLEDO) CP 45710. Seventh. Any complaint related to manufacturing defects must be made in writing within one year from the delivery of the goods. The customer must send the complaint form correctly filled and also samples of the defective materials, if needed, within 15 days after the acknowledgement of the complaint. Once the complaint is accepted, the customer shall make available the defective goods within a maximum period of 1 month in order to be picked up by Saleplas. Saleplas, S.L. is responsible for replacing the defective materials, ex-cluding any other liability for compensation or damages caused by our products. Saleplas, S.L. will not be liable for any potential problem arising for any private transport agency. Eighth. The guarantee of our products is one year from the delivery date, which will be the one stated in the delivery note. A wrong in-stallation/handling of our products will cancel any guarantee or responsibility on the part of Saleplas, S.L. Ninth. Unless concession or credit granted, the payments will always be made by cash deposit or bank transfer before the delivery of the goods. No payment delay will be admitted under any circumstances, taking into consideration that any failure to pay will entail the cancellation of the guarantee of the supplied products as well as the standstill of pending orders of the customer, if any. This entitles Saa¡leplas, S.L. to take the necessary measures to ensure the payment of the credit amounts. Tenth. Our customer service hours by telephone and in our offices will be: mornings 9 to 14 h, afternoons 16 to 19 h from the 1st Febru-ary to the 30th September, and afternoons 15 to 18 h from the 1st October to 31st January. Eleventh. According to the Spanish Personal Data Protection Law (Ley Orgánica 15/1999 de Protección de Datos), the customer under-stands and accepts that once an offer or order is requested, the information transmitted to us shall become part of a database owned by Saleplas, S.L. Those data will be managed confidentially and the final purpose will be management of the contractual relationships, send-ing of commercial offers and advertisement materials. The customer may exercise his rights of access, modification or cancellation by sending a written note to Saleplas, S.L. Ctra.
