Key Requirements - Worker training, record keeping, air monitoring, and medical surveillance are required for employees who work with or around asbestos or materials presumed by regulation to contain asbestos.
- As a minimum, basic awareness training is required for housekeeping employees who may disturb asbestos or presumed asbestos (Class IV Work). Requirements are progressively more stringent up to Class I Work which is the abatement of thermal system insulation.
- Thermal system insulation and sprayed-on or trowelled-on surfacing material applied prior to 1981 and resilient flooring materials applied prior to 1980 are presumed to be asbestos-containing material unless proven otherwise by an asbestos inspection.
- Notification should be given to the regulatory authority prior to asbestos removal (including demolition projects).
- Asbestos must be transported in water-tight containers that are properly marked.
- Disposal of asbestos must take place in a landfill approved by EPA.
- Final air clearance testing may be required before removal is considered complete and area can be reoccupied
Penalties - Facility managers who have not identified materials containing asbestos in the work environment could be placing the health of employees and subcontractors at risk. Negligent breach of duty can result in fines of $1,000 per day and unlimited civil liability.
