The employer is responsible for health and safety and therefore has certain duties that they must meet to comply with legislation. Consideration must be taken regarding the risks from Legionella that may affect employees, staff and the public and appropriate precautions must be implemented. Employers must ensure that:

• sources of risk are identified
• risks are managed, prevented and controlled
• up-to-date records are kept for at least 5 years
• any other duties are carried out
• a competent person or persons is appointed to take day-to-day responsibility for controlling any identified risks.

If during the risk assessment a significant risk of Legionella bacteria is found, then an effective management system with clearly defined responsibilities and lines of communication must be implemented. At this stage, it is also advised that a risk review and audit program is implemented. Regular monitoring of water systems, carried out as part of a legionella risk management programme, will greatly reduce the risk of legionella. Additionally, on-going monitoring and management is essential to ensure continued compliance.
