Phase I & II Environmental Site Assessments (AAI)
Under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), purchasing, or even leasing commercial real estate subjects the buyer/lessor to the environmental liability that exists at the property. Implementing proper Due Diligence prior to the purchase or lease, affords clients the legal protection of an `innocent landowner defense.` Trileaf performs Phase I Environmental Site Assessments in accordance with All Appropriate Inquiry (AAI), ASTM, the industry, and the current legal standard of Due Diligence.
Phase II Environmental Site Assessment
When a Phase I Site assessment comes back with a “Recognized Environmental Condition,” many clients choose to complete a further “intrusive” investigation to determine the extent and/or cause of the condition. Environmental Reviews — Portfolio Audits
Trileaf has completed portfolio reviews containing thousands of sites for environmental compliance and/or risk, typically due to a Merger or Acquisition. Trileaf’s review team will mobilize to the location of the information, and we have completed the review of thousands of individual sites in a single portfolio within 15 business days. Trileaf maintains our own proprietary tracker to make sense of the information when communicating with our client. We will thoroughly review Phase I & II reports, NEPA Reports, and any other compliance documentation your require and notify you by site of their accuracy, completeness, and most importantly, alert you to your exposures.
Asbestos / Lead Paint Inspections
For certain properties, it is wise to add Asbestos and Lead Paint Inspections as an additional scope item to a Phase I AAI Report. Also, Prior to renovation, demolition or property transactions, asbestos and / or lead based paint surveys are often required. The asbestos surveys include review of building plans/specifications, developing a sampling plan to be required. The asbestos surveys include review of building plans/specifications, developing a sampling strategy, and collecting bulk samples. Bulk samples are analyzed utilizing a polarized light microscope (PLM) to determine the presence of asbestos. Materials containing greater than one percent asbestos are considered asbestos-containing. Survey results are tabulated in a format allowing the building owner to take a proactive approach to managing the asbestos.
