As long as hydrocarbon fuels remain in use as primary fuel sources for heating, transportation, and manufacturing, underground (UST’s) and aboveground (AST’s) storage tanks will be required to store fuels. Historically, hydrocarbon storage tanks have been a major source of environmental liability for property owners / tenants, and lenders, due to the mobile and volatile nature of hydrocarbon products, leaking tanks, improperly installed fuel systems, poor maintenance procedures, and spills.

All can potentially contribute to significant surface and subsurface hydrocarbon contamination issues. These issues often include:

  • Residual soil contamination issues that may pose a health concern during future construction activities,
  • Health and safety concerns as potentially explosive vapours enter adjacent buildings and utility corridors,
  • Potential groundwater contamination, and off property migration of contaminants
In Ontario, several regulations and guidelines have been written in an attempt to regulate the installation and removal procedures, maintenance procedures, and clean-up procedures for UST and AST systems and products. The two (2) major regulations that apply to UST’s and AST’s include:
  • Fuel Oil Code (O. REG. 213/01)
  • Applies to all facilities that have underground fuel oil storage tanks that are used for heating oil

Liquid Fuels Handling Code (O.REG. 217/01)
Applies to all facilities that have underground/aboveground storage tanks where gasoline, or an associated product is handled, loaded, dispensed to be used as a fuel in motor vehicles

Both these regulations provide specific instructions on installation procedures, maintenance, and mitigative measures that should be taken if a problem is discovered. Proper maintenance, and the development of a UST/AST management plan are critical elements in minimizing the potential for creating an environmental liability. The development of an UST/AST management plan generally includes the review of installation and maintenance records, the inspection of all tanks by a licensed contractor, leak testing, and possible soil and groundwater testing in the vicinity of the tanks.
