Waste Management Project Description
EQ conducted a multimedia compliance assessment as part of a merger and acquisition due diligence evaluation for an international cement manufacturer. The review indicated that existing air permits and hazardous waste generator registration notices were not inclusive of all operations. The assessment concluded that there was significant probability that regulatory agencies would consider the facility to be out of compliance with TRI reporting requirements, NPDES discharge limits, air permit emission limits, RCRA reporting requirements, generator 90-day storage limitations, CWA spill prevention and counter-measure plan requirements, and storm water best management plan requirements.
Within 10 days of completing the acquisition, the client self-reported the suspected violations and sought amnesty under applicable state and federal policies. EQ prepared permit applications, provided staff training, and monitored the compliance schedules and progress being made toward achieving compliance. Compliance with all applicable requirements was certified within 240 days of having notified EPA of the suspected violations. Administrative agreements and consent orders were negotiated and penalties were reduced by more than $300,000.
