Making Jurisdictional Determinations Under the Navigable Waters Protection Rule
The process for identifying Jurisdictional Wetlands and Waters of the US (WOTUS)has undergone major changes the last several years. We have gone from a 1986 WOTUS rule, updated to a 2015 Clean Water Rule and then back to a 2019 WOTUS rule reminiscent of the 1986 rule. Finally, concluding with the latest the Navigable Waters Protection Rule in 2020. All of this has led to a lot of confusion over what is and what is not jurisdictional under the Clean Water Act. The old rules and guidance are out. Just because the Corps may have regulated a wetland or waterbody in the past does not mean that it is regulated today.
To help sort this all out the Swamp School has developed an online and on-demand workshop based on the new rules, published and unpublished guidance, and conversations with key Corps regulatory personal. We have asked the questions and we have received answers to many of the issues that were a bit grey in the regulations. We also will present several strategies for using Approved Jurisdictional Determinations (AJD) and Preliminary Jurisdictional Determinations (PJD). From all of this we have put together a great workshop for you.

This workshop will include a review of the Navigable Waters Protection Rule and how it relates to making defendable jurisdictional determinations. From there we will present project examples of various project scenarios that induce wetland and stream components. These scenarios are intended to illustrate a variety of jurisdictional and non-jurisdictional water bodies.
We encourage students to pose project specific questions to both the instructor and fellow students using a class forum. Several student generated project assignments will also be used to illustrate an understanding of the new rules. The class will also include several quizzes deigned to reinforce the learning process.
Upon successful conclusion of tis workshop you will understand how to make a jurisdictional determination for wetland, streams and other waterbodies. You will also learn whether an Approved Jurisdictional Determination (AJD) or Preliminary Jurisdictional Determination (PJD) is more appropriate for a given project.
