
USACOE 2020 Nationwide Permits

On September 15, 2020 the US Army Corps of Engineers published the new and revised nationwide permits for work in wetlands and other waters that are regulated by Section 404 of the Clean Water Act and/or Section 10 of the Rivers and Harbors Act of 1899. The Corps proposal includes five new nationwide permits related to seaweed mariculture activities, finfish mariculture activities, electric utility line and telecommunications activities, utility line activities for water and other substances, and water reclamation and reuse facilities. Public comments are on or before November 16, 2020.

The nationwide permits are designed to authorize activities that cause minimal adverse environmental impacts to aquatic resources separately or on a cumulative basis. Activities range from work associated with aids to navigation and utility lines to residential developments and maintenance activities.
These new permits are out or will soon be out for public comment and become effective very soon. To help you understand the intricacies of these new permits, the Swamp School is hosting a 2-hour webinar on the updates to the 52 permits plus a review of the 5 new permits. We will also focus on the significant changes to the energy related permits with special focus on the Nationwide #12 permit.
For anyone who has taken our August regulatory updates webinar, this is an important complement and expansion to that webinar that provides additional information you need to perform your job.
The webinar will include a live presentation with live chat. You will have access to online resource materials (manuals, regulations, court documents, etc.), slide handouts, and an office discussion board to post questions and answers before or after the live webinar.
This webinar will be recorded so you can access it at a later time if you can’t make the original class time or to revisit any of the topics discussed. Students will have access to the recorded webinar for 30 days after the broadcast.
