Workshop on Cross-Border Insolvency Proceedings
The purpose of this course is to introduce lawyers to practical aspects of cross-border insolvency proceedings. An optional visit to the Court of Justice of the European Union in Luxembourg (with the possibility to attend a hearing) will be offered to participants in the morning of the first seminar day.

The seminar will kick off in the afternoon with an introduction to insolvency law; differences between national insolvency legislations will be highlighted. The new EU Directive on restructuring and insolvency will also be on the agenda.
In the following days, the seminar will focus on the highly important EU Regulation No 2015/848 on insolvency proceedings and discuss major case law and best practice regarding:
- centre of main interest (COMI) and forum shopping
- coordination of proceedings
- the relation of insolvency, cross-border security and rights in rem
EU legislation and the recent CJEU case law will be presented.
Participants will be able to deepen their knowledge through case studies and daily workshops.
Lawyers practising or intending to practise in the field of (cross-border) insolvency law; insolvency administrators seeking an introduction to cross-border insolvency law.
